Case Study: heritage support for listed building application for regularisation of works undertaken outside of discharging conditions

Overview: Weiser Heritage Consultancy is pleased to have received notice that Listed Building Consent has been granted on an application which we were appointed to provide heritage related planning support. WHC managed the project including assistance in appointing an architect, drafting and submitting the listed building application and monitoring the process.
WHC Role: WHC was brought in by the client. A former farmstead with a listed farmhouse and curtilage listed farm buildings, the site had consent from 2018 for the conversion of the outbuildings to holiday lets. Unfortunately, some of the conditions associated with the consent were not formally discharged and some of the work was not carried out according to the approved drawings. The client made several attempts to discharge the conditions based upon the existing, but as the works did not match the approved drawings, did not include sufficient information and were undertaken prior to the conditions being formally discharged the council was not willing to support the works. Our involvement included a full site visit, collaboration with both the architect and the client, and detailed review of the proposed drawings and providing a Heritage Statement to accompany the listed building application. Our years of conservation and architectural/design experience proved invaluable.
Heritage Assessment: The wider site includes the following heritage assets the listed farmhouse, curtilage listed outbuildings, adjacent listed cottage and a conservation area.
Planning Policy & Public Benefit: The heritage statement was prepared with careful reference to the National Planning Policy Framework (NPPF) and relevant local planning policies. Whilst the level of harm was less than substantial, there were no public benefits associated with this proposal. The application provided sufficient justification and argument to support the minor alterations to the approved application.
Outcome: After numerous attempts by the client to address the outstanding works and undischarged conditions, WHC’s application successfully finalised the outstanding issues.
Conclusion: Sometimes an alternative approach to resolving outstanding issues can prove successful.
